Umm also the victim was 17 and only in the 10th grade? Seems a little old to be in the 10th grade. Shit when I was 17 I was almost graduating high school which is 12th grade. Think I turned 18 right before I graduated

Just another animal with no discipline raised with no supervision reverting to animal behavior. Not only is the kid to blame but his parents are to blame. He is still young enough to have parental influence or lack there of mold his decision making process but certainly old enough to know right from wrong. Every case like this should result in death penalty or prison for the kid and the parents. This disgusts me. We are raising a nation of criminals.

My woman's two girls were not used to discipline, and still don't receive it from their father. When we first pick them up from him I give them a quick reminder in the car ("girls, what does this face mean?") and after that I can put them in check in 2 secs flat with just a glance. I love it. =)

And I don't want them all in jail Cris, you know as well as I do this country is becoming mostly shitbags... you can't have 20% work to pay for the other 80%. That would make me go postal on one of the fine Federal Correctional Institutions we have stockpiled here in Florida. They'd ask me why I did it and I'd say "to lower my bills & taxes".

Does anyone recall the case of Michael Hernandez? At 14, he brutally murdered his classmate, Jaime Gough, also 14, by stabbing him multiple times and slashing his throat, during school, as well. This happened in Miami back in 2004. I remember his parents hiring every shrink, every child psychology expert, etc. They tried to say he was insane, blah, blah blah. He was tried as an adult, and was convicted. He received a life sentence, although it took four years from crime to trial/conviction.

Let's see how this one turns out.

I beg to differ. Yes, murder is murder and the kid has to pay the price, but it is natural/animal instinct to fight over "pussy" and the kid's escalation of a fight by bringing a lethal weapon absolutely crossed the line and was a very poor decision that he has to pay for for the rest of his life. However, to kill someone for the pleasure of killing someone is sociopathic. That's why this kid is only being charged with 2nd degree murder and not premeditated 1st degree.

The boundaries you're drawing are correct, but by defining what it means to commit premeditated murder in any regards would be what he did. He had ample time to conceive a plan prior to initiating the actual act.
The reasoning should not be defined in a case like this to me. Of course it's all a matter opinions at this point, but by legal definition the kid should have to pay for a premeditated charge.

I think this kid is a stupid dumbass, and the things I'm hearing about his home environment supports the lack of guidance. But personally, I've seen attacks with screwdrivers and rocks that never ended in death but easily could have. I wonder how many fist fights escalated to a blade being drawn.

And Phil the argument could be made that you didn't commit premeditate becuase you are legally carrying a firearm/weapon and have it in the case you need to defend your life. This kid was illegally carrying a weapon and in no time (I am assuming here as was on school grounds and from what I know the other kid did not have a weapon) was he in fear for his life. Hence it could be deemed that he brought the weapon with the intent to use it. When you leave your home you are legally carrying and don't have the intent to use (unless you obviously are forced to)

Florida isn't that bad for legit citizens defending themselves. South Florida is really the worst for crime too. And Florida is at least making things a little better for us, glad it's not becoming more restrictive.

But if I did leave this state, I would definitely prefer a place like Missouri, Vermont, or another free state that allows open carry but requires a permit for concealed carry - I do believe that system is best for defense and crime deterring. This way you can have a permit, use an OWB holster and whether it shows or not you don't care because it is being carried in a fashion that is obviously not criminal in nature.

B: Making sure that there is a Yukon in the garage sitting next to the Eoropean import. Making sure that little Johnny has all the latest and coolest things..PS 3, Ipod, the latest phones, etc, etc.

My 15 yr old nephew (not really..best friends kid) is so busy smokin weed and drinkin that school is secondary. His mom is the one giving the shit to him. My buddy sits there and does nothing. What they don't realize is that instead of being parents, they are crippling him for the rest of his life. I assure you this boy will be in and out of jail, work many many jobs, and is basically screwed. I have tried many times to talk to them and tell them they are just fucking this poor kid over, and I keep getting the same excuse. "It's better that he does it here, than in the streets. He's gonna do it anyway, so why not at home!"

You're right! i lived in Ocala, for about a year or so and it was great! Nothing but country. Now it's a little screwed up with race and the same city crime, but the point is in the country alot of the intolerance you will find in the city is obsolete in a country setting.

Having lived in Albany, NY less then a year ago I can say for a fact that there was much less crime there then here. Dont get me wrong, there were a few bad areas but here its everywhere. I have never seen such bad crime and I use to spend a lot of time in NYC growing up. This area, Broward and Dade, is a total shit hole. The best I can do while here is more in to Palm Beach county, where it seems slightly better. Bottom line, this area is the worst for crime. Conversely, it is the best for 2nd amendment rights. Where NY was much better with crime but TERRIBLE for 2nd amendment rights. Is there anywhere where I can carry a gun and not be in fear of my life all the time?

Palm Beach isn't all that great either sir! The crime rate in Palm Beach may or may not be high but I can tell you from personal experience that they have an increasing amount of Haitian gang activity. It is on the rise! I watched a serveillance video from one local LEO agency that had Palm Beach Sheriff's Officers squaring off with some of these fools in downtown PB and whooping ass, but it seemed like they had infinite numbers and wouldn't stay down.
