The suit seeks back pay for the teen and a permanent injunction against the retailer from participating in what it describes as discriminatory employment practices. It seeks undisclosed monetary and non-monetary losses resulting from "emotional pain, suffering, anxiety, loss of enjoyment of life, humiliation and inconvenience."
Loss of enjoyment of life???? That's funny.

This lawsuit wouldn't fly in Florida. We're a right-to-work state. Muslim's used to sue when their employers wouldn't let them have extra breaks every 3-4 hours for prayer. Judgments came down that employees are protected from discrimination for their beliefs, but that does not extend to activities or actions that violate existing company policies that were in place before the employee ever started there.
So, since Abercrombie had an existing policy toward dress code the applicant would have to be shown the policy and then decide if they will obey the policy or not in order to work there.
What dumbshit lawyer thought such a lawsuit would fly? Maybe he took the case just to get his name in the news because he knows a retarded unwinnable case usually does the trick?
