View Full Version : Process for obtaining a Class 3, Title 2 or NFA weapon

The transfer tax on machine guns, short barreled rifles, short barreled shotguns, and suppressors is $200 payable to the BATFE. The transfer tax on AOWs is $5 and is also payable to the BATFE. This transfer tax is a one time only tax and not an annual tax. Each time an NFA weapon changes hands, the tax is charged except if the transfer is between class 3 dealers.
The paperwork required for the transfer of an NFA weapon consists of an application known as the Form 4. The Form 4 is completed and submitted with the applicant's photograph attached and a fingerprint card. These are submitted the Bureau of Alcohol, Tobacco, Firearms and Explosives in duplicate along with the respective transfer tax. The finger print cards are forwarded to the FBI for a background check. The background check and transfer process takes about 2 months or so depending on the examiners’ work load and if there are any errors on the preparers part.
Once the Form 4 application is approved, one copy of the approved application with a "stamp" is sent back to the dealer or seller of the weapon. The dealer or seller contacts the buyer and makes the physical transfer of the weapon at that time. The approved Form 4 application stays with the weapon and is proof that the buyer has paid the transfer tax. The original should be stored in a safe place and a photocopy carried with the weapon should the legality of the NFA weapon be questioned by law enforcement officers.

In my quest to get a sbs, i am beginning to look into the paperwork. Can the forms be submitted ahead of time prior to me actually purchasing the firearm of choice?

Take my case for example. I want to purchase the Tromix s17 which is an sbs. I do not want to purchase it at the moment, but maybe a few months down the road. Is it allowed that i submit my application, wait for approval before purchasing this weapon. Or does a serial number of a weapon need to be attached to the form? Where do i go about obtaining a Form 4?

correct the serial number just be supplied at time paperwork is filed... side note... i have spoken with tony rumore the master behing tromix...one hell of a gunsmith and the s17 is an awesome weapon!.... i hear the waiting list is 2 years though

Serbu Super Shorty is 800$, readily available, made in Tampa, and is classified AOW which is only a 5$ tax stamp.

What's the cost on the Tromix?

Tromix's are commanding a higher price these days since I believe Tromix stopped doing the conversions on them. I have seen them sell quickly at $1200.

I was just checking on some things at the ATF website and noticed that they are now hosting pdf versions of the NFA forms. Welcome to the 21st century! I've been using "bootlegged" pdf's for some time and making tweeks/modifications to them with adobe. Now, with their forms, you can be sure to have the latest and greatest so to speak.

Here's the link to their forms which you will only need Form 1 and Form 4 as an individual. If you have a chance, check out their rulings section of their website. Interesting info.

So you will no longer need duplicates since you are filling out basically two of the same form, just designated to its recipient now?

All F1's and F4's must be submitted in duplicate still. They still need to keep an original in their files as well.
