View Full Version : POLL: Tampa Shooting - Self Defense?

Here is the original story of a gang banging beaner that was smacking his woman around in the party district of Tampa a week ago.

http://www.tampabay.com/news/publicsafety/crime/article1081686.ece

And here is the follow-up a few days later. The girlfriend and 2 "family members" went to the police demanding to know why the shooter wasn't arrested. The police released more details about the events that night. Witnesses confirmed that the girlfriend was getting beat, the shooter intervened to help the girl, the thug made verbal threats to kill the shooter more than once, the shooter identified himself as being legally armed, the thug continued threats and motioned toward the shooter, and the shooter pulled his weapon and planted one in his chest.

When questioned whether verbal threats of death were enough to justify self-defense the Tampa police department simply said "yes they are". Now this case is being sent to the State Attorney's Office. Once the SAO makes their official ruling it will clarify whether this situation permits the use of deadly force in self-defense.

Anti-gunners will jump on this to say it will make people trigger happy, but I see this as a warning to criminals/punks/scum that they will get shot if they commit violence and make threats. How many times have you seen some punk threaten someone before jumping them and the victim did something as little as look at the punk because they were acting like an idiot? I welcome this warning to idiots that think they can skate that misdemeanor violence line. And having them keep their loud mouths shut, for fear of being shot, is an added bonus.

Shoot off an email to the SAO and support this kid Jones for stepping in and doing the right thing for a stupid ungrateful bitch that didn't deserve the help but got it anyway.

This helps define the line of when you can draw even clearer and will make legally armed citizens more confident in their decisions... which will lower hesitation and save more lives.

Damn that is fucked! Anti-gunners will be running wild on this one. I think he was justified, especially since they say he was reaching in his waistband after verbally threatening to kill him. Guess the dumb bitch liked being a punching bag. Have any contact info on her, I need to let some aggression out.

I beliveve he was right in shoot because of the threat to their life and the reaching to the waistband... you dont want to wait till he is pointing you in the head and/or waiting to see the other guy brandishing a gun.

neither of the articles says if the boyfriend killed was armed. was he?

That bitch needs to be beat to an inch of her life, to remind her of the life she was looking forward to staying with that scumbag. Justice was served in my eyes. This will be a good case to win for law abiding conceal weapon permit holders.

Sounds like he deserved to die, but I didn't think a death threat was enough to justify a killing. As much as I wish the laws were that way, I can not believe the police let him go. I honestly figured you'd go to jail for a shooting like that. Usually the law puts us in a position where we are already facing a potentially fatal situation such as a gun or knife already coming at us.

If I were a cop I think to enforce the laws, I'd have arrested him.

However, I am not a cop so I say SCORE ONE FOR THE GUN OWNERS!

He made verbal threats and then reached in his pants for something. That constitutes his actions in my book.

The other instructors are going to jump you for saying that Cris... no matter how much we all agree. =)

Whether the punk was armed with anything is regardless to the situation as far as I'm concerned. The fact that a motion was made after threatening "death or serious bodily injury" implies the actions of that individual and this will help clarify that you don't need to wait until the bad guy points a gun at you before you can draw and defend.

RC, a dumb bitch like that has got to be on MySpace, Facebook, and shit like that screaming to the internet. She won't be hard to look up.

Cris, stay away from Hialeah... I know what you're thinking.

Neither article said if the guy was even armed. If it was me, I'd have my gun cocked and loaded anytime I'd be in Ybor (which would be fucking NEVER) and I'd watch the guy. If he reaches into his pants, I'd put my hand on my gun. If he pulls a weapon out, I kill him, because I bet I'm a better draw and shot.

Although thinking it is nice, it's never like the real thing, but that's the why I'd hope it would go just to be safe not you get arrested and butt raped in prison.

Personally I think a threat plus attemtping to approach is enough. You never know what a person will do, what they are carrying or how far they will take something. honestly its a fine line but why should you risk serious injury, possible short or long term disability if not death over some moron. Talk is talk and words will hurt nothing more than pride and feelings at most but anything past that to me that honestly makes one feel threatened should be enough skim the trash off the top of the gene pool. Its sad when criminals have more spokesmen and at times more rights than good honest people.

yh that fact that he knew the guy was carrying (which was stupid to tell him), still threatened him and he started to reach for his waist was enough. What was he suppose to wait til the guy drew a gun on him? By that time it's way too late

I believe in that situation informing the offender they are fucking with an armed citizen was the right thing to do. You are allowed to declare your intent to defend yourself with deadly force (and some states require you to warn offenders verbally... even if you only have martial arts training).

Honestly, for the situation that Jones was in, I think he did it nearly textbook. He disrupted a crime in progress, responded to verbal threats of serious bodily injury or death with a warning that he will defend with deadly force, continued to receive threats and the suspect made a motion toward him in disregard of the given warning. Only at that point did the shooter draw. From there the adage of "only draw if you have decided to shoot" takes control.

End result, one less punk on the street and his homies and bitch being shown the cold shoulder by the cops. Fucking beautiful actually. Let it be a lessen to little punk asses everywhere.

Btw, here is the original story that went up by the news station. I like how they didn't portray the shooter as evil and actually called him a Good Samaritan. Very nice.

Had it been me in that situation I simply would have pulled my pistol and point it at his head and then pull back the hammer and warn him that if he took one step towards me or move his hands I would give him a 230 grain attitude adjustment. Hopefully he would not be stupid enough to ignore my threat, and I would not worry about a possible run in with the law.

Come on, look at her screen name Vangsta! Gangsta biatch likes the smack down. I hope this guy gets off clean as a whistle, only bad part he is gonna have to carry locked and loaded cuz I am sure he will have to watch his back now for sometime. Scumbags make me sick, I have no quams with this shoot and am glad the shooter did not wait to get hurt or worse.
